Court orders hospital to compensate woman for negative HIV test

The Ha Tinh general Hospital in the central province of Ha Tinh will have to compensate dong 14 million (US$875) for a woman after it disclosed her name as a HIV carrier while its HIV test is incorrect.

On May 31 the People’s Court of Ha Tinh Province heard that a woman named Nguyen Thi Thanh accused the hospital of releasing her name as a HIV carrier even though the hospital test was later proved negative. The court attracted the participation of many locals.

According to judges, the hospital left out wrong information about its patient, which leads to spiritual crisis, suspicion between the woman and her husband and her newborn child was not breast-fed as a result.

The court announced that the hospital must compensate 3.6 million dong for the woman’s “spiritual losses” and 10.9 million dong to buy milk for her child totalling 14.5 million dong.

The hospital also has to apologise the woman at her house before the witness of local officials.
