HK businessperson accused of raping teen daughter and leaving her with ‘unerasable psychological scar’

A Mong Kok businessperson raped and molested his teenage daughter over a period of two years, prosecutors told a Hong Kong court on Tuesday.

The attacks left an “unerasable psychological scar” on the 15-year-old, prosecutor Susanna Ku Pui-fong said on the first day of the trial in the High Court.

The suspect, a 59-year-old father of two known in court as HJD, has pleaded not guilty to one count of rape or incest, and another count of indecent assault on his daughter, X. Neither can be named for legal reasons.

“The prosecution says the defendant, knowing X is his biological daughter and that X did not consent to it … had sexual intercourse with her,” Ku said in her opening remarks.

Now 18, the girl was allegedly first raped by her father in 2015, when she was in Form 3.

Two years later he put his hand on her chest, just days after she hinted something had happened in a form submitted at her school.

Ku said the girl was asked to fill in a form about topics that could be raised by her teachers at a parents’ day in 2017.

On the form the girl wrote she felt “fear at home”, and went on to talk about “an unerasable psychological scar”.

Ku told the court the man had married X’s mother on the mainland, before moving both mother and daughter to Hong Kong.

The alleged assaults took place in a Mong Kok residential building, where the family of four, including X’s younger sister, lived, and where the father ran a photography studio.

Ku said the first assault occurred during the summer holidays in 2015, when the accused woke X up in the middle of the night to force himself on her, she said.

Although the wife and husband divorced in 2016, they remained in the same building, but lived on different floors.

In February 2017, X brought up the alleged rape for the first time in the form she handed to school.

She also wrote she wished to have her mother’s company at night, after the first assault took place when the mother was at dance practice.

“He has done something he really should not have done,” a tearful X is said to have told a teacher when asked about the form.

The teacher brought up the matter during the meeting with X’s mother on February 18, but reportedly

got a lukewarm response.

Ku said just two days later the father molested X again, this time while she was doing homework in her mother’s flat.

A social worker at the school was notified the next day, and the matter was referred to the police.

A forensic scientist found a tear in X’s hymen, while X also said she had seen blood around her private parts after the 2015 incident.

“The prosecution says it was caused by the sexual intercourse with the father,” Ku said.

The trial continues before Albert Wong Sung-hau on Wednesday.
