Indonesian waiter charged with raping 13-year-old student

A waiter has been charged at Sessions Court with raping a 13-year-old student who he recently got acquainted.

The 29-year-old Indonesian allegedly committed the offence at a shop house in Tuaran area from 5am to 6am on September 2.

He however pleaded not guilty to the offence.

The accused was charged under Section 375 (g) of the Penal Code (rape with or without consent when she is under 16 years of age) and could be charged with Section 376 (1) of the same act, which carries up to 20 years imprisonment and whipping, if found guilty.

Sessions Court judge Noor Hafisah Mohd Salim set October 19 for case management while awaiting medical and chemical results from relevant parties.

Noor Hafisah also set January 21 to 23 next year as trial dates. The accused was not granted bail.

Prosecution was conducted by deputy public prosecutor Dinesh Raja while the accused was represented by lawyer Goldam Hamid.
